CCC, a leader in advancing copyright, accelerating knowledge, and powering innovation, today announced the election of international intellectual property and artificial intelligence (AI) law expert Dr. Daniel J. Gervais to its Board of Directors.
Gervais currently serves as the Milton R. Underwood Chair in Law at Vanderbilt University Law School, where he is also director of the Vanderbilt Intellectual Property Program and co-director of the Master of Laws (LL.M.) Program. He is a member of the American Law Institute, serving as Associate Reporter on the Restatement of the Law Copyright Project.
“AI-related advancements will be strengthened by relying on responsibly sourced copyrighted works,” said Tracey Armstrong, President and CEO, CCC. “As an expert in copyright law and collective licensing, Dr. Gervais’ insights will be a significant addition to CCC’s Board as we create licensing solutions that meet the needs of technology companies, users of copyrighted works, creators, and publishers with regard to AI.”
Gervais previously worked for 10 years researching and addressing policy issues as a legal officer at the World Trade Organization (WTO), head of the Copyright Projects section of the World Intellectual Property Organization (WIPO), deputy secretary general of the International Confederation of Societies of Authors and Composers (CISAC), and vice-chair of the International Federation of Reproduction Rights Organizations (IFRRO). Before joining the Vanderbilt Law faculty in 2008, Gervais served as acting dean and vice-dean for research of the Common Law Section at the University of Ottawa. In 2012, he was the Gide Loyrette Nouel Visiting Chair at Sciences Po Law School in Paris and became the first North American law professor admitted to the Academy of Europe. Before entering the academy, he practiced law as a partner with the technology law firm BCF in Montreal, was a consultant with the Paris-based Organization for Economic Cooperation and Development, served as a visiting professor at international universities, and was a visiting scholar at Stanford Law School. Gervais became president of the International Association for the Advancement of Teaching and Research in Intellectual Property (ATRIP) in 2017 and was a Distinguished Fulbright Chair at Carleton University in 2022. He is the first Distinguished Fellow of the Institute for Information Law (IvIR) of the University of Amsterdam.
Gervais is the author of The TRIPS Agreement: Drafting History and Analysis, a leading guide to the text that governs international intellectual property rights and recently published an article entitled “Collective Licensing and AI.” He was also a featured panelist on CCC’s February 2024 LinkedIn Live Town Hall event, “The Heart of the Matter: Copyright, AI Training and LLMs,” where he discussed technical and legal aspects of the use of copyrighted content in AI systems. His work was published in Science, several leading law reviews, and other peer-reviewed publications. In 2023, he also published a legal sci-fi story entitled Forever.
